Match Pop Terms of Use
The short version
- You may play Match Pop for your own personal, non-commercial enjoyment.
- Coins, boosters, lives and other items in the game are virtual. They have no cash value and cannot be exchanged for money.
- Purchases are made through Apple, and refunds are requested from Apple.
- Your progress and purchased items are saved on your device, with a copy in your own iCloud when iCloud is on. Without iCloud, deleting the app or changing devices loses them.
1. About these terms
These Terms of Use ("Terms") are an agreement between you and Idan Menashe Debbi, an individual developer publishing under the brand name IdanGames ("we", "us"). IdanGames is a brand name, not a registered company. By downloading or playing Match Pop (the "Game") you agree to these Terms. If you do not agree, please do not use the Game.
If you are under 18, or under the age of majority where you live, you may play only with the permission of a parent or guardian, who should read these Terms with you and agrees to them on your behalf. Children under 13 should play only with a parent or guardian's involvement. In-app purchases must be made or approved by a parent or guardian, who is responsible for purchases made on devices they control; Apple's Screen Time and Ask to Buy can require that approval.
Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived or limited by contract.
2. Your licence to play
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the Game on Apple devices that you own or control, as permitted by Apple's Usage Rules in the Apple Media Services Terms and Conditions, for your own non-commercial use. We keep all rights we do not expressly give you.
3. Virtual coins and items
The Game includes virtual items such as coins, boosters, lives, periods of unlimited lives and similar features ("Virtual Items"). You can earn some by playing and buy some with real money.
- Virtual Items are licensed to you for use in the Game only. You do not own them, and they are not property, currency or a stored-value product.
- They have no cash value and cannot be redeemed for money, goods or anything outside the Game, sold, traded or transferred to anyone else or to another device, except where the law requires otherwise.
- Virtual Items are used up when you use them in the Game (for example, a booster when you play it, or coins when you spend them).
- Periods of unlimited lives run for the stated time once they start, whether or not you are playing.
- We may change how Virtual Items work, their prices in coins and how they are earned, for example to balance the Game. Such changes apply from the update that makes them; an update does not take away coins or items you already hold.
4. In-app purchases
- The Game is free to download. In-app purchases are optional and are consumable: each purchase delivers Virtual Items once, and they are used up as you play.
- Prices are shown in the Game and on the App Store purchase screen in your local currency, as set by Apple, including any taxes Apple collects. The price shown on Apple's confirmation screen is the price you pay.
- Purchases are delivered to the copy of the Game on the device where you made them. Apple does not restore consumable purchases: items you have not used yet come back only with your iCloud copy (section 6), and items already used are not given again.
- If you were charged but did not receive your items, reopen the Game on the same device with an internet connection: it checks the App Store's record and delivers purchases that were not delivered. If that does not help, contact us (section 16) with your Apple Order ID.
- Some offers are available only once, or only from a certain level or after a certain amount of play. Their conditions are shown in the Game.
5. Payments and refunds
All payments are processed by Apple under Apple's terms. We do not receive or store your payment details and we cannot issue refunds ourselves. To request a refund, use Apple's reportaproblem.apple.com or contact Apple Support. Apple decides refund requests under its own policies and applicable law.
Depending on where you live, you may have a legal right to cancel a purchase of digital content within a set period, which can end once the content is delivered with your agreement. Apple handles such cancellations under the Apple Media Services Terms and Conditions. Nothing in these Terms affects that right.
If you believe a purchase did not work as described, you can also contact us (section 16), and we will help, for example by checking that it was delivered.
6. Saved progress
The Game saves your progress and Virtual Items on your device. It has no account system. If iCloud is turned on for your Apple Account, the Game also keeps a copy in your own iCloud and restores it automatically when you reinstall the Game, or install it on another iPhone with the same Apple Account, as long as that installation has not yet made a purchase of its own (see our Privacy Policy).
- Without iCloud, or for progress that had not reached iCloud yet (for example when playing offline just before deleting the Game), your progress and Virtual Items, including purchased ones, may be permanently lost if you delete the Game or lose or replace your device. We cannot restore them because we do not hold a copy.
- A device backup you make yourself may also contain your progress; we do not control whether restoring it brings your progress back.
We say this in the App Store description too, so that you know it before you buy. If something was paid for and not received, see section 16.
7. Fair play
You agree not to:
- copy, modify, distribute, sell or rent the Game or any part of it;
- decompile, reverse engineer or disassemble the Game, except to the extent the law expressly allows it;
- use cheats, bots, modified versions of the Game, or tools that alter the Game, its save files or its network traffic;
- deliberately exploit bugs or errors to obtain Virtual Items, or interfere with our purchase systems;
- use the Game unlawfully or in a way that harms us or others.
Please tell us about bugs instead. If you break these rules, we may suspend or end your use of the Game, where the law allows.
8. Changes to the Game
We are continually improving the Game. We may add, change or remove levels, features, offers and content, and release updates that you may need to install to keep playing. We may also stop offering the Game, or stop selling in-app purchases, at any time. Because the Game saves your progress on your device and does not need an account, a copy already installed may continue to work, but we cannot promise that it will work with future versions of iOS. When the Game is withdrawn, unused Virtual Items are not exchanged or refunded, except where the law where you live requires otherwise.
9. Intellectual property
The Game, including its code, artwork, 3D models, sounds, music, levels, text, the names "Match Pop" and "IdanGames" and their logos, belongs to us or to our licensors and is protected by copyright and other laws. Some components are used under third-party licences and remain subject to those licences. If you send us ideas or feedback, we may use them without obligation to you.
10. Privacy
Our Privacy Policy explains what data the Game uses and the choices you have, including switching analytics off in Settings.
11. Disclaimers
To the extent the law allows, the Game is provided "as is" and "as available", without warranties of any kind, express or implied, including that it will be uninterrupted, error-free or available on every device. Some countries do not allow these exclusions, so they may not apply to you, and your statutory rights are not affected.
12. Limitation of liability
To the extent the law allows, we are not liable for loss that was not reasonably foreseeable when you started using the Game, or for loss of progress or Virtual Items caused by deleting the Game, resetting, losing or replacing your device, or restoring a backup (section 6). To the extent the law allows, our total liability to you for all claims relating to the Game is limited to the greater of the amount you paid for in-app purchases in the Game in the twelve months before the claim, or USD 50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for damage caused intentionally or by gross negligence, or your rights as a consumer under the mandatory laws of the country where you live.
13. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the Game or its content. In particular:
- Apple has no obligation to provide maintenance or support for the Game.
- If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the Game (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the Game.
- We, not Apple, are responsible for addressing any claims by you or third parties relating to the Game, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
- If a third party claims that the Game infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the Game.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Ending these terms
You may stop using the Game at any time by deleting it. These Terms end automatically if you break them; when they end, you must stop using the Game. Sections 3, 9 and 11 to 15 continue to apply after the Terms end.
15. Governing law
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules, and disputes will be heard by the competent courts of the State of Israel. If you are a consumer, this choice of law does not take away the protection of the mandatory laws of the country where you live, and you may also bring a claim in the courts of that country. Before going to court, please contact us (section 16): most problems can be solved by email.
16. Support and complaints
For help, complaints or questions about these Terms, see the Support page or email idandebi1234@gmail.com. We read every message and aim to reply as soon as we can.
Idan Menashe Debbi (IdanGames), idandebi1234@gmail.com.
17. Changes to these terms
We may update these Terms, for example when the Game changes or the law requires it. We will change the "Last updated" date above and, for material changes, give notice in the Game or on this website. If you keep playing after a change takes effect, the updated Terms apply. If any part of these Terms is found unenforceable, the rest remains in effect.
